Dear all,

I don't want to be controversial but:

1.- There's been no butchering, stealing, spitting on someones face, etc. The mesh was not released (as far as I know, and I'm the one who asked for it). Caravaggio warned everybody that it can't be done and the mesh was not released.

2.- I'm sure Kaede did their work with his/her best intention. Everybody does mistakes and everybody has not read a readme.txt sometimes.

3.- I respect all the work that FR community does. Tommyboy, Renegade, Texas Jack, Benton Grey, Stumpy, Prev, M25 and so on. I know that if we have this community so alive is for their work and their talent, and I'm very happy of being part of it with my little and sloppy part. I also want to state that Kaede's work deserves all of our respect too (at least mine) even if it can't be released.

4.- Thanks for the advices Caravaggio. I'll keep them in mind. :)

if someone is creating a "hex" of the punisher_TJ mesh will he be able to release it even with TJ not around?

On the other hand, the link you wrote seems very clear. One of the things I said to TJ in the PM was including him as original author of some parts of the mesh anyway.

But I'd wait some time before making a decission in order to wait for a response from TJ. Besides Caravaggio was quite clear about this (and he was right, because we don't have direct permission from TJ).

dude, don't you understand the meaning of WIP? that means, it's a work in progress, that means that the only thing that featured in the mesh was the skoped design and not focus on the skin yet... and didn't you even noticed that, the belts and the cratridges in the harness are just the same as with the solid_snake mesh and the Punisher_TJ mesh? it's like you specifically searched for a skin that was the same as what i used, man just try reading my post here, http://freedomreborn.net/archive/index.php?topic=42001.720 , i already told them that some are just default skins from the mesh, and as a WIP as it is, i will only finish the skin if lmalonsof was already granted by TJ to release it... so the mesh/skin won't be realesed, and not because of kitbashing, but just because there's no permission from TJ yet...

But explicit permission has not been given. Hexing is not the same as skoping, in fact we have meshers here who have given permission for hexing but withheld permission for skinning. Its possible a mesher is ok with hexing but not at all with skoping. Until we know we can't assume.
If you guys spent your time looking for alternate, skope safe meshes instead of trying to win an already lost argument, you'd have a releasable duke already.
OR those of you who want this duke mesh so bad, you could spend an hour of your time learning a bit of skoping and then maybe you could make it yourself. While releasing skoped TJ stuff is not allowed, what you do with it in the privacy of your own home is not an issue. Kaede can obviously use this Duke skope all day and TJ, me or anyone else cant do anything about it.
TJ might turn around and give the go ahead on all his stuff one day. He might let us skope his stuff, and that would be grand, but until we have it in wiritingf rom the man himself, we can't assume we have any right to do what we want with his work.

Yeah so far as we know a hex is fine, all that involves is hiding and unhiding parts of a mesh that exist already. You aren't adding or removing anything, you're just removing the ability to see parts of the mesh. The authors original vision is still present in some form within the mesh. It should be fine to release it, as evidenced in a previous post that shows TJ giving permission for such a thing.

The problem with skoping is, you can change the original mesh to a point where it no longer resembles the original...imagine painting an image only to have someone download/photograph it, change it, then claim ownership for it, claiming its their talent that made it. Then they get credit for it. That would seem, to you, like stealing.
In communities like this over the net, credit can get lost disturbingly easy. Thats why some people tend to come down so hard on this sort of thing.

Kaede, lots of people, AA, Podmark, and Detourne among them all said how amazing that duke skin looked. You did mention that it was parts from other standard skins, but i think the problem was you didn't say you intended to replace them. Kittbashing (using other peoples skins parts) is a lynching offence 'round here, and when a newer member previews something that includes work from other artists, some people tend to think 'kittbasher!'. While you never said you would release it with the kittbashed skins, you didn't say you would replace them with your own either. (you since have but in your original posts i couldn't see it). It seems that NomadX was alerting you to the fact that particular duke combo can't be released as is. If you had mentioned you would be replacing the 'borrowed' skin bits, we would all be fine with it. Saying its a WIP could refer to the skin, parts of the skin and not others, keyframes or the mesh/skoped parts itself, if you don't specify, we wont know which bits you are doing urself, or which parts come from other artists.

Ok now to make things clear... I am putting Duke on hold, and not releasing it, until TJ says the go... coz i'm caught up with Anime projects as of now, and as i release this Duke, it will have new skins made by me, and not kitbashed from any other skins...  :thumbup:

Isn't that what Kaede is doing now?
And perhaps he let us a free reign to skope his meshes.

GGiant,   Zivon23 asked TJ if Shevek (another mesher, and author of the Deadpool mesh) would be able to take the ponytail from TJ's Warblade mesh, and put it onto his Deadpool mesh.

TJ was ok with that.   however this doesn't give us license to interpret his comments in any way that benefits us.  in the link you posted,  someone else had replied with the reasonable comment that the only person that know Texas Jack's intention is Texas Jack himself.
For now we just have to wait and see.

This is not about having desperately a Duke Nukem mesh at all costs to play myself with it and become mad of fun thinking 'I'm Duke, come on alien scum!', it's about having a mesh/skin that can be released as part of a mod. That's why I started the thread and if it can't be done, it won't be done.

As I said, I'd wait until any new from TJ. If we don't have any after some time, I'd re-evaluate the situation and then think in possible options.

there is so much in this thread that is pissing me off, and if i actually posted what i'm thinking i would be banned

there are so many people who give and give for this community and then there are bunch of stupid morons who cant seem to read the simple rules and respect the wishes of other

they have really started to make this place lose a lot of its appeal.

Texas Jack has yet to give permission to skope his meshes. So until then I think that it behooves all of us to think of them as untouchable. Moreover I don't believe that any of us are skoping or skinning Webriders meshes out of respect to him. He was taken from us to soon. Look guys...poke around and read the posts here....you'll find out the do's and don'ts by simply reading and getting to know the people in this forum. Just try to be respectful and when in doubt you can ask anyone here...for the most part we're a tolerant and helpful bunch.
